Terms & Conditions
The following terms and conditions apply to all Xavier Furniture Outlet transactions. The use of this website or purchase from us constitutes to your agreement to these Terms & Conditions.
Placement & Acceptance of Orders:
1.2 The Terms and Conditions together with your order after it is accepted by Xavier Furniture will constitute a contract between you and Xavier Furniture. The order cannot be varied unless Xavier Furniture agrees to vary it in writing or by email.
1.3 Xavier Furniture reserves the right to decline any order placed via this website.
Delivery:
2.2 The Customer must clearly specify site access and delivery requirements at the time of placing the order. These requirements and site access will be reviewed by Xavier Furniture prior to accepting your order. Failure to disclose full detail of site access, may result in a Failed Delivery Fee and any subsequent costs incurred will be payable prior to redelivery attempt.
2.3 Xavier Furniture reserves the right to revise freight costs calculated by the website system if there are any errors and / or where higher freight costs are higher than expected
2.4 Xavier Furniture has the right to cancel or delay any order at any time before the supply of the Products by giving written notice to the Customer. Xavier Furniture will not be liable for any loss arising from such cancellation or delay.
2.5 The Customer is responsible for ensuring that the items ordered can be accommodated on site e.g. items can fit through doors, up staircases, etc. Xavier Furniture is not obliged to accept a return for these reasons.
2.6 The Customer is responsible for supplying correct delivery address details at the time of placing the order. The Customer will be liable for any additional freight costs charged by the carrier.
2.7 Delivery times provided by Xavier Furniture and/or its nominated carriers are estimates only and given in good faith.
2.8 If the Customer fails to accept delivery of the order, the Customer may be liable to pay for failed delivery attempts / storage of the products.
2.9 The Customer is responsible for checking the condition of the cartons delivered. In the event of damage / fault, the damage must be pointed out to the carrier on arrival and the Customer is to note the damages on the delivery docket that the Customer will be requested to sign. The customer must retain all packaging materials and report to outlet@xavierfurniture.com.au immediately and provide photographic evidence via email of any damages / imperfections.
2.10 Any freight damage claims are to be notified in writing to outlet@xavierfurniture.com.au within 2 working days of delivery. This process is required regardless of discussions with the delivery company at time of delivery.
2.11 Freight damage is not the responsibility of Xavier Furniture. Where possible, Xavier Furniture will lodge a freight damage claim with the carrier.
Installation Services:
Collection of orders:
4.1 Collections from our Loganholme warehouse is subject to the following conditions:
- Collection is only available by prior arrangement
- Between 8.30am and 4.00pm on Monday to Friday
- 24 hours’ notice is required prior to collection. Please call 0738065370 with your Order number, to arrange your collection time.
- Photo identification may be requested at time of collection as verification.
- If you are arranging a carrier to collect your goods, you must provide the carrier with a copy of your order with your Name and Items purchased, for cross-checking at collection time. This must be pre-booked by calling 0738065370.
4.2 The Customer is responsible for insuring the Products against loss or damage during transit for collections by themselves or their nominated carriers. Xavier Furniture is not responsible for any damage that occurs in transit.
4.3 OH&S prohibits our staff from loading into private vehicles. Please bring person/s to load your vehicle. We also suggest that you bring blankets / packaging to protect goods.
Pricing and Payment:
5.2 Payments are to be made at the time of placing the order.
5.3 Prices are subject to change without notice.
5.4 Xavier Furniture is entitled to sell products to other Customers at prices which are different to the prices which are charged to Customers (via the Website) from time to time.
General Terms:
Release and Acknowledgement
(a) loss (including consequential loss) in relation to property or otherwise;
(b) personal injury, disease or illness to, or death of, persons;
(c) economic loss; or
(d) loss in relation to the environment.
Approximations & Variances
7.2 The Xavier Furniture range includes many items that have unique characteristics and are frequently produced with natural materials. Minor variations may also be present in the touch, feel or grain of a product. The shade or colour of a Product may vary from batch to batch, and may differ from images shown on Xavier Furniture’s website. Any such variations will not be considered a defect nor will it be deemed to be a defect.
7.3 Dimensions and details can vary slightly from batch to batch. Whenever multiple units are ordered by the Customer, Xavier Furniture will endeavour to send them from the same batch where stock is available.
Warranty
(i) there is a failure to follow Xavier Furniture’s care instructions.
(ii) if the Product is relocated from its original delivery, and the relocation caused damage because the product was inappropriately packaged or otherwise.
(iii) the furniture is subject to a use for which it is not intended, including but not limited to damage caused by more than “normal” wear, spills such as acid, solvents, dyes or other corrosive materials, ink, paint, or body fluids, moisture of any kind, improper cleaning techniques or other negligence and placing furniture outdoors.
Privacy Act
9.2 The Customer acknowledges having read and understood the Supplier’s Privacy Policy which may be viewed on the Supplier’s website.
